This End User License Agreement (the “Agreement“) is a binding agreement between you and CURE100, Inc., a New York not-for-profit corporation (“CURE100“). This Agreement governs your use of CURE100’s Carbon Tracker application (the “Carbon Tracker App“). By accessing the Carbon Tracker App, you acknowledge that you have read and understand this Agreement, accept this Agreement and agree that you are legally bound by its terms. If you do not agree to these terms, do not use the Carbon Tracker App.

CURE100 grants you a non-exclusive, non-sublicensable and nontransferable license to access and use the Carbon Tracker App for your personal, non-commercial use. You agree not to: (a) copy, modify or otherwise create derivative works of the Carbon Tracker App; (b) sell or license the Carbon Tracker App to others; (c) reverse engineer or otherwise attempt to gain access to any software component of the Carbon Tracker App; or (d) use the Cabon Tracker App in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law. If you provide to CURE100 any comments, suggestions, recommendations or feedback relating to the Carbon Tracker App (“Feedback“), you hereby assign to CURE100 all right, title, and interest in, and CURE100 is free to use, without any attribution or compensation to you, any and all ideas or other intellectual property rights contained in the Feedback, for any purpose whatsoever, although CURE100 is not required to use any Feedback

You acknowledge that when you use the Carbon Tracker App, CURE100 will collect information about your use of the Carbon Tracker App. You also may be required to provide CURE100 with information, data, and other content, including certain information about yourself, that is submitted by or on behalf of you through the Carbon Tracker App (“Your Data“). All information CURE100 collects through the Carbon Tracker App is subject to CURE100’s Privacy Policy available at https://cure100.org/privacy-policy. You agree that CURE100 may reproduce, distribute, and otherwise use and display Your Data as necessary for CURE100 to operate the Carbon Tracker App. By using, and providing information to or through the Carbon Tracker App, you consent to all actions taken by CURE100 with respect to your information in compliance with CURE100’s Privacy Policy. You acknowledge that CURE100 may send you marketing communications or otherwise contact you to offer you certain products or services, including informing you of opportunities to reduce your carbon footprint. You will have an opportunity to unsubscribe from such communications at any time.You understand that CURE100 retains the right to use Your Data in a de-identified, aggregated manner such that it is not reasonably possible to identify you.
